Definitions

The following definitions apply:

“CJ-Australia.com”, “Construction Jobs Australia”, We”, “Us”, “Our” means Construction Jobs Australia trading as CJ-Australia.com registered company number: 15585883.

"Employer" means any person, company or organisation that has set up an account with CJ-Australia for the purposes of finding candidates for either their own jobs or as an agent acting on behalf of another organisation looking for candidates to fill their jobs.

“Job Seeker” means an individual who has registered to use the CJ-Australia.com Site for the purpose of finding a job.

"Commencement Date" means the date for the commencement of the Services as set out in the Order Confirmation.

"Services" means all of the recruitment services provided by Us from time to time.

“Contract” means the contract between Us and the Recruiter for the provision of Services governed by these Terms.

"Terms" means these terms and conditions.

"Site" or “Website” means www.CJ-Australia.com and its content. 

“User” means an individual working at the employer who the primary account holder has provided with a login by which they can access Our Services and Site on behalf of said company or organisation. Every User has the same abilities and access to the Services as the primary account holder and must abide by these Terms in their use of the Services and Site. The failure of any User to abide by these Terms may result in the suspension of termination of Service.


By submitting a vacancy to the Site, the Client is authorising CJ-Australia to post such vacancy on the site.

At the discretion of CJ-Australia a Service may be offered where jobs are replicated from a Recruiters website or some other nominated source. Where this Service is offered CJ-Australia will make all reasonable attempts to replicate the job description accurately.

CJ-Australia may at its discretion offer software integrations which enable Recruiters to submit vacancies via this software. We retain the right to change or discontinue the provision of these software integrations at any time.

The Employer is responsible for the content of the vacancy regardless of whether this is submitted directly, via third party software or if the posting is replicated from their website or other nominated source and will indemnify CJ-Australia against any claim, loss, liability, expense and/or damage ("Losses") in connection therewith.

Job Posts will be active for a maximum of 30 days. Recruiters can elect to set a close date earlier than 30 days at their discretion. A Job Post can be reposted after it has ended.

CJ-Australia does not guarantee any response to your Job Post or that responses will be from individuals suitable for the job advertised.



Provision of Services Employers

These Terms and Conditions apply to your agreement with Us for your use of the following services, which collectively will be known as the “Services”. Terms and Conditions apply to all of the Services except for where they are expressly stated to apply to one Service only.

1.    Job Posting service, which allows employers to place job advertisements on the CJ-Australia website and for Job Seekers to view and apply for these jobs by making an application directly through the Site or by being re-directed to a third-party website to apply through that website.

 

2.    Featured Job Posts, which provide greater prominence than a standard Job Posting by inclusion in a carousel on the Website home page and by Featured Job branding in Job Seeker job search returns Social media promotions inc Linkedin Facebook & Twitter.

3.    CV Search, which provides the employer with access to a search engine for the purpose of finding and viewing Job Seeker CVs and profile information which match the criteria and filtering set by the employer. Various bundles of CV downloads may be purchased, see additional information in the Pricing section below. employer can elect to view and/or download a CV at their discretion subject there purchase status

 4.  Featured employer, which provides the employer with a logo on the website that links to their Recruiter Directory entry where they can create a profile of their organisation for an agreed time.

5.    Candidate Alerts, which allows Recruiters to specify criteria and then receive emails containing details of Job Seekers that fulfil that specified criteria on a frequency that they determine. Recruiters can set up multiple job alerts and Recruiters can amend or stop alerts at any time by accessing their dashboard.

CJ-Australia may, in its sole and absolute discretion, add to, modify or discontinue any of the Services from time to time. However, this will not affect any Order Confirmation agreed prior to any change or withdrawal of the relevant Service.

CJ-Australia shall provide the Services in accordance with these Terms. Recruiters must set up an account in order to gain access to the Services.

Job Posts


Rules for Job Posts

The following rules apply for all Job Posts including Featured job Posts, Optimised Job Posts, and any other Job Posts CJ-Australia might offer as a Service from time to time. These rules are designed to ensure that Recruiters receive the most applicable response to their jobs and that Job Seekers are treated fairly and safely.

The employer must include the following information in the job post:

The employer must provide sufficient true and accurate details about itself and the job to applicants including, but not limited to the employer identity, the nature of its business, the nature of the role, the requirements of the role, the commencement date, the likely duration, the hours of work, the location, the remuneration, the intervals of payment and available benefits.

Applications will either be sent to the employer by an email from CJ-Australia or via an application made on their own website which is made accessible from a link in the job post. Employers can choose which of these options to use when setting up a job post. When a employer chooses to receive applications by email the application will include the CV and personal information provided by the Job Seeker in support of their application and this information will also be accessible in their account. The employer will be the sole Data Controller for this information and will have the same responsibilities to adhere to the Privacy Act & data protection legislation as though they downloaded the information from the Site.

The employer is solely responsible for verifying the information provided by a Job Seeker in their application. The employer is responsible for checking the Job Seekers identity, qualifications, skills, experience, eligibility to work, training, membership of professional bodies and all other information provided. CJ-Australia accepts no responsibility for validating information provided in any application and makes no warranties as to the accuracy of said information

All and any subsequent dealings between the Recruiter and any Job Seeker in connection with the applicant's response to the job posting are the responsibility of the Recruiter, CJ-Australia accepts no liability whatsoever therewith. The Recruiter will indemnify Us against any Losses in connection therewith.

The employer must not duplicate jobs.

The employer must not place any contact details in any job description, including but not limited to URLs telephone number and email addresses. Applications should only be encouraged via the 'Apply for this Job' button on each Job Post which will either enable the Job seeker to apply via the Site or will redirect them to the Recruiters own website for the purpose of making an application.

Job Titles and descriptions must not include strings of keywords that are designed to improve ranking on pages to the detriment of the understanding of the Job Post.

The employer must only advertise legitimate jobs in good faith. The posting of adverts for jobs that do not exist, pyramid schemes, franchise opportunities and other products and services are not allowed. The employer must not request that any Job Seekers who make an application make a payment in order for their application to be processed.

Recruiters must remove Job Posts at the earliest opportunity after a Job is filled or if it becomes unavailable.

All jobs posted on the Site must have an active link to the employer website where this is the method of application. Links must be active and enabled for the duration of the Job Post.

The employer will comply with all applicable laws, including without limitation: the privacy act 1988 the Data Protection Act 2018 and the Equality Act 2010.

Any vacancy submitted to the Site must comply with the Code of Practice on Employment provided by the Equality and Human Rights Commission, which can be viewed at: https://www.equalityhumanrights.com/en/publication-download/employment-statutory-code-practice

The employer shall not submit for inclusion in any job posting any material which breaches copyright law, is illegal, defamatory, libellous, offensive, fraudulent, violent, discriminatory, obscene or sexually explicit or which may adversely affect the reputation of CJ-Australia or the Site.

Job Posts should not be targeted at Job Seekers under the age of 18.

Job Posts should not be submitted for vacancies where there is a risk to the health and safety of any applicant unless the Recruiter informs Job Seekers of such risks and the steps taken to prevent or control such risks.

The employer accepts sole responsibility for any detriment which it may suffer or incur in respect of the engagement of an applicant and shall hold CJ-Australia harmless against any Losses in connection therewith.

The employer shall use all reasonable endeavours to ensure that it will not be detrimental to the interests of the applicant it intends to engage to work for the Recruiter in the vacancy posted.
